Biosecurity legislation 

MPI works within a robust legislative framework to lead New Zealand’s biosecurity system.  
The biosecurity system prevents or manages risks from harmful organisms, like pests and diseases. The biosecurity system helps protect New Zealand’s economy, environment, human health, and a range of social and cultural values.

It does this by: 
– stopping pests and diseases before they arrive 
– dealing with any if they do enter the country.

Biosecurity Act 1993

Biosecurity Act 1993 is an Act of Parliament in New Zealand. The Act is a restatement and reform of the laws relating to pests and other unwanted organisms. It was a world first.​ 
The Biosecurity Act provides the legal framework to help keep harmful organisms out of New Zealand. And how to respond, and manage them, if any do make it into the country.​ 
Phytophthora agathidicida is listed as an “Unwanted Organism” (UO) defined as one that “is capable or potentially capable of causing unwanted harm to any natural and physical resources or human health”.​ 
As a UO, Clauses 52 and 53 relate directly to actions involving PA. These protect NZ by essentially making it an offence to move PA without an approved plan or process in place.

National Pest Management Plan

A national pest management plan (NPMP) is a biosecurity regulation that can be made under the Biosecurity Act 1993. NPMPs are used for tackling major biosecurity threats and are the strongest form of regulation that the Ministry of Primary Industries (MPI) can put in place for an established pest.​ 
In 2022 a National PA Pest Management Plan introduced 10 rules to help protect Kauri from the PA pathogen that causes kauri dieback disease.

3.) Restriction on the movement of kauri​ 

NPMP rules that apply in ‘kauri lands’ (Northland, Auckland, Waikato, Bay of Plenty:​

6.) Stock exclusion notice​ 
7.) Restriction on the release of animals​ 
8.) Obligation to clean items before entering or exiting kauri forest​ 
9.) Obligation to use cleaning stations​ 
10). Open tracks and roads in kauri forest

In essence, all these plans prevent the movement of PA risk material (soil, plant material, etc.) in to and out of Kauri Hygiene Zones (KHZs) unless in accordance with an approved PA risk management plan.
